FLOPS ("we," "our," or "us") operates flopsindex.com and related services (collectively, the "Platform"). This policy explains what information we collect, how we use it, and your rights in relation to it.

FLOPS is a compute intelligence platform that publishes institutional-grade reference indices for GPU and compute infrastructure markets, operated in the United States.

2. Information we collect

We collect information in the following categories: account information (name, email address, company name, and job title when you register or contact us); usage data (pages visited, API calls made, query parameters, and timestamps); contributor data (pricing submissions and associated metadata provided under Index Eligibility Agreements); communications (emails and support requests); authentication data (if you sign in via Microsoft, we receive a user token and email address — we do not store your Microsoft password); and payment information (processed by our payment provider, not stored on our servers).

3. How we use your information

We use your information to provide and operate the Platform, authenticate users, communicate about your account and updates, monitor performance, and comply with legal obligations. We do not sell your personal information to third parties. We do not use your data for advertising purposes.

4. Data sharing

We share data only with service providers who process data on our behalf under appropriate agreements, with Microsoft Entra ID for authentication, where required by law or court order, and in connection with a business transfer such as a merger or acquisition.

5. Data retention

We retain account and usage data for as long as your account is active and for a reasonable period thereafter. Contributor pricing submissions are retained for the duration required to maintain index integrity and audit trails. You may request deletion of your personal data at any time.

6. Cookies and tracking

We use minimal first-party cookies necessary to maintain session state and authentication. We may use privacy-respecting analytics tools that do not fingerprint individual users. You can disable cookies in your browser settings, though this may affect authentication functionality.

7. Security

We implement industry-standard security practices including encrypted connections (TLS), access controls, and routine security reviews. If you believe your account has been compromised, contact us immediately at team@flopsindex.com.

8. Your rights

Depending on your jurisdiction, you may have the right to access, correct, or delete your personal data, object to or restrict certain processing, and request data portability. To exercise any of these rights, email team@flopsindex.com. We will respond within 30 days.

9. International transfers

FLOPS operates from the United States. If you access the Platform from outside the US, your data may be transferred to and processed in the United States under appropriate safeguards.

10. Children

The Platform is intended for professional and institutional use. We do not knowingly collect personal information from individuals under 18 years of age.

11. Changes to this policy

We may update this policy from time to time. Material changes will be communicated via email or via a notice on the Platform. Continued use after changes take effect constitutes acceptance of the revised policy.
